Welcome to ClipToFrame. By accessing or using our Service at cliptoframe.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Service Description

ClipToFrame provides an API service that enables users to extract frames (images) from video files at specified timestamps. The Service includes:

  • A web interface for manual frame extraction
  • A RESTful API for programmatic access
  • Batch processing capabilities
  • Integration support for automation platforms (n8n, Make.com, Zapier)

3. User Registration and Accounts

3.1 Account Creation

To access certain features, you must create an account providing accurate and complete information including your email address, name, country, and other requested details.

3.2 Age Requirement

You must be at least 16 years of age to use this Service. By creating an account, you represent that you meet this age requirement. If you are under 18, you confirm that you have parental or guardian consent.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to notify us immediately of any unauthorized access.

4. Acceptable Use Policy

4.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for ensuring you have the necessary rights, licenses, or permissions to process any video content through our Service.

4.2 Prohibited Activities

You agree NOT to use the Service to:

  • Process content that infringes third-party intellectual property rights
  • Extract frames from content you do not own or have permission to use
  • Process illegal content, including but not limited to child sexual abuse material (CSAM)
  • Attempt to circumvent rate limits, security measures, or access restrictions
  • Use the Service for any purpose that violates applicable laws or regulations
  • Resell, redistribute, or sublicense access to the API without authorization

5. Intellectual Property

5.1 Your Content

You retain all rights to the video content you process through our Service. By using the Service, you grant ClipToFrame a limited, temporary license to process your content solely for the purpose of providing the Service.

5.2 Our Service

The ClipToFrame service, including its API, documentation, and website, is protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

5.3 User Indemnification

You agree to indemnify and hold harmless ClipToFrame from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, including but not limited to claims related to content you process that infringes third-party rights.

6. Service Availability and Pricing

6.1 Free Tier

The Service is currently provided free of charge with usage limits. We reserve the right to introduce paid plans, modify pricing, or change free tier limitations at any time with reasonable notice.

6.2 Rate Limits

The Service is subject to rate limits and usage quotas. These limits may vary by plan and are subject to change. Current limits are displayed in your dashboard.

6.3 Service Modifications

We may modify, suspend, or discontinue the Service (or any part thereof) at any time. We will make reasonable efforts to notify users of significant changes.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, available at cliptoframe.com/privacy. The Privacy Policy explains how we collect, use, and protect your personal data in compliance with GDPR and other applicable regulations.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ClipToFrame shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or €100, whichever is greater.

You may stop using the Service at any time. To delete your account and data, contact us at legal@cliptoframe.com.

10.2 By Us

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice, for any violation of these Terms or for any other reason at our discretion.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on our website or sending you an email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain and the European Union, without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain, unless mandatory consumer protection laws of your country of residence provide otherwise.
